By accessing or using AKTI SURVEY (the "Service"), operated by AKTIFUL LLC ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

AKTI SURVEY is a web-based platform that allows users to:

  • Create and design surveys with various question types
  • Distribute surveys to respondents
  • Collect and analyze survey responses
  • Manage survey collectors and coordinators

3. User Accounts

3.1 Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. Acceptable Use

You agree NOT to use the Service to:

  • Collect sensitive personal information (SSN, financial data, health records, biometric data) without proper authorization and safeguards
  • Create surveys that are illegal, fraudulent, defamatory, or harmful
  • Harass, abuse, or harm other users or respondents
  • Distribute spam, malware, or malicious content
  • Impersonate others or misrepresent your affiliation
  • Violate any applicable laws or regulations
  • Attempt to gain unauthorized access to the Service or its systems
  • Use automated systems to access the Service without permission

5. Survey Content and Data

5.1 Your Content

You retain ownership of surveys you create and data you collect. You are solely responsible for the content of your surveys and ensuring compliance with applicable laws.

5.2 Data Collection Limits

In accordance with our Privacy Policy, survey creators should limit personally identifying information (PII) collection to:

  • Email address
  • Phone number
  • Name

Collecting PII beyond these fields is a violation of our policies and may result in account termination.

5.3 License to Us

By using the Service, you grant us a limited license to host, store, and display your content solely for the purpose of providing the Service.

6. Intellectual Property

6.1 Our Property

The Service, including its design, features, and content (excluding user-generated content), is owned by AKTIFUL LLC and protected by intellectual property laws.

6.2 Trademarks

AKTI SURVEY, AKTIFUL, and associated logos are trademarks of AKTIFUL LLC. You may not use these marks without our prior written consent.

7. Payment Terms

Certain features of the Service may require payment. By subscribing to paid features:

  • You agree to pay all applicable fees
  • Fees are non-refundable unless otherwise stated
  • We may change pricing with 30 days notice
  • Failure to pay may result in service suspension

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AKTIFUL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless AKTIFUL LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Modifications to Terms

We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the effective date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
